IMMIGRATION TO IRELAND

Ireland has a very open economy and as such, it benefits from the boom in world trade. The national drive to encourage overseas companies to relocate here has existed in Ireland for many decades. Many companies have placed Ireland at the center of their European networks since the combination of various factors make Ireland an obvious choice. Ireland’s sympathetic tax regime and financial support systems for research and development emphasize the Government’s determination to attract foreign business.

IRELAND: IMMIGRATION FOR INVESTORS

Successful applicants will be granted residence in Ireland for two years which can then be renewed for a further three years. After five years, participants under the program will be permitted to apply for long term residence in Ireland.

In order to be considered for the programme the investor must propose an investment in one or more of the following categories:

1. A minimum investment of €1,000,000 in government bonds issued by Ireland. The bond has a term of five years and an annual interest rate of 0%
2. Investment in a residential property of a minimum value of 450 000 EUR and a straight investment of 500 000 EUR into the immigrant investor bond. The minimum of total investment : 950 000 EUR.
3. A minimum investment of € 500,000 in Irish enterprises for at least 3 years. The enterprise may be a start-up established by the investor or an existing business registered in Ireland. The enterprise must be registered and located in Ireland
4. Investment funds: Invest the amount of €500,000 in an approved fund.
5. Real Estate Investment: A minimum investment of €2 million in any Irish REIT that is listed on the Irish Stock Exchange. The €2 million investment may be spread across a number of different Irish REITs.

IRELAND: EVALUATION PROCESS

The application process has two stages:

I. Stage one – application for investment and immigration approval. In the application stage candidates will submit their applications and all related documentation for approval by the Evaluation Committee.

II. Stage two – issue of residence permission: Once approved, the permission will be issued with the residence authorizations when the following conditions have been met:

1. The proposed investment was followed through and evidence of the transfer of funds has been supplied to INIS.
2. The applicant has submitted the required affidavit confirming their good character and lack of criminal convictions.

IRELAND: RENEWAL

Permission will be renewed and afterward subject to:

1. The investment remaining in place for the designated period
2. An assessment by the Evaluation Committee of the integrity of the investment
3. The candidates upholding their good character
4. The candidates maintaining their private medical insurance.

On renewal, residency permission will be granted for three years. Subsequent permission may be renewed in five year installments.

IRELAND: CITIZENSHIP (NATURALISATION)

1. Have been living in Ireland continuously for five (5) consecutive years or five (5) years during the preceding eight (8) years;
2. Have been residing in Ireland for the 12-month period immediately preceding your application,
3. Intend to continue to reside in Ireland after naturalisation,
4. Make a declaration of fidelity to the Nation and loyalty to the State.

IRELAND: CITIZENSHIP BY BIRTH

A person born in the island of Ireland after 1 January 2005 to parents, at least one of whom was an Irish or British citizen, has an entitlement of Irish citizenship.

Otherwise, a person born in the island of Ireland after 1 January 2005 is entitled to Irish citizenship only if, during the four (4) year period immediately preceding the person’s birth, one of the parents has been resident of Ireland for a period of not less than three (3) years.

IRELAND: CITIZENSHIP THROUGH DESCENT

1. If either of your parents was an Irish citizen at the time of your birth, you are an Irish citizen, irrespective of the location.
2. If you were born outside Ireland to an Irish citizen who was himself or herself born in Ireland, then you are entitled to be an Irish citizen.
3. If you are of the third or subsequent generation born abroad to an Irish citizen (in other words, one of your parents is an Irish citizen but none of your parents or grandparents were born in Ireland), you may be entitled to become an Irish citizen by having your birth registered in the Foreign Births Register; this depends on whether your parent through whom you derive Irish citizenship had himself or herself become an Irish citizen by being registered in the Foreign Births Register before you were born. 

IRELAND: CITIZENSHIP BY NATURALIZATION

Naturalization is a process whereby a non-Irish national can apply to become an Irish citizen. If you are applying for naturalization based on your own residence in the State, the conditions for naturalization are as follows:

1. You must be of legal age (18+)
2. You must prove to be of good character.
3. You must have had a period of one (1) year’s continuous reckonable residence in the State immediately before the date of the application and, during the eight (8) years preceding that, have had a total reckonable residence in the State amounting to four (4) years
4. You must intend in good faith to continue to reside in the State after naturalization by making a declaration of fidelity to the nation and loyalty to the State and undertake to faithfully observe the laws of the State and to respect its democratic values.

CONDITIONS

1. Is of legal age (18+),
2. Are married to each other, have been married to each other for a period of not less than three (3) years, living together, as attested to by proclamation submitted by the resident to the Minister in the prescribed form, OR
3. Are civil partners of each other, have been civil partners of each other for a period of not less than three (3) years, and are living together, as attested to by affidavit submitted by the citizen to the Minister in the prescribed form,
4. Is, in the case of a spouse, in a marriage recognized under the local laws,
5. Has at least one (1)year’s continuous residence on the island of Ireland,
6. Had, during the four (4) years immediately preceding, a total residence in Ireland totaling at least 2 years,
7. Intends, in good faith to continue to reside in Ireland after naturalization,
8. Made a declaration of fidelity to the nation and loyalty to the State,
9. Undertaken to faithfully observe the laws of the State and to respect its democratic values.

COMPANIES IN IRELAND

The following types of company are available to entrepreneurs looking to set up a business in Ireland and must be registered with the CRO (Companies Registration Office). Please note some exceptions apply and INIMEX INC. will gladly provide further details on this matter:

1. Single member company – this type of company allows for a person (acting alone) to start a company limited by shares or a guarantee company with share capital;

2. Private company limited by shares – for such a company, the liability is limited to the amount owed to the members;

3. Private company limited by guarantee with share capital – in this case, the liability is limited to the contribution by the members to the assets of the company and the amount owed on such shares;

4. Limited Partnership – it is not a separate legal entity and requires one limited partner and one general partner (maximum 20 persons). The limited members’ liability is limited to their contribution and the general member’s liability is unlimited (as per Limited Partnership Act 1907);

5. Public limited company – the liability is limited by shares.There is a minimum requirement of 7 members and a minimum capital of €38,000;

6. Public company limited by guarantee (without share capital) – the liability is limited to the contribution by the members to the assets of the company, in the event of its closing;

7. Unlimited company – public/private – shareholders have unlimited liability;

8. Undertakings for Collective Investment in Transferable Securities (UCITS) – Public Limited Companies formed under EC Regulation and the Companies Acts (1963 – -2012). Summarized as the collective investment in transferable securities of publicly-raised capital operating under risk-sharing basis;

9. European Economic Interest Groupings (EEIG) – options where businesses within the EU can engage in cross-border trade to facilitate or develop its members’ economic activities;

10. European Company (‘Societas Europaea‘) – this type of business can operate across Europe and must comply with EU law directly applicable in all member countries;

11. Place of business or Branch – any company incorporated outside Ireland must register the opening of any Branch or Place of Business with the CRO (E.C. Regulations– S.I. no. 395 of 1993 or  Part XI of the Companies Act 1963) within 30 days of such opening;

Corporate tax in Ireland

• 12.5% on trading income;
• 25% on non-trading income (investments, rental, etc.);

Rates of duty on residential property purchased in Ireland

• 1% of the purchase price for a property, up to €1 000 000;

• 2% for any excess of the purchase price over €1 000 000.
