LUXEMBOURG : ACTS AND REGULATIONS

Article 53a created by the Law of 8 March 2017 specifies the criteria for obtaining the “investor” residence permit.

LUXEMBOURG: CONDITIONS

To obtain residence permit for investors, the non-European nationals need to invest in a future or existing business in Luxembourg, in a future or existing investment management structure or in form of a deposit with a financial institution (see conditions below for details):

  1. having invested at least EUR 500,000 in an existing company with its registered office in Luxembourg and commit to keep it for a duration of at least 5 years (The investment must comprise at least 75% of own funds. 25% of the investment may be borrowed over a minimum term of three years) or;
  2. to invest at least EUR 500,000 in a new business still to be created, with its registered office in Luxembourg and at least 5 work positions which must be created within 3 years of the incorporation of the business. The recruitment of staff must be in collaboration with the National Employment Agency (Agence pour le développement de l’emploi – ADEM)
    With regard to investments in existing or still to be created businesses (investments of at least EUR 500,000), the company must or will have to carry out a commercial, crafts or industrial activity or;
  3. to invest at least EUR 3 million (The investment must comprise at least 75% of own funds. 25% of the investment may be borrowed over a minimum term of 3 years ) in a management and investment structure, either existing or still to be created, with its registered office in Luxembourg where it must have and maintain the necessary substance or;
  4. to invest at least EUR 20 million in the form of a deposit of funds with a financial institution established in Luxembourg, and with the commitment to keep said deposit for at least 5 years. The investment must consist of 100% of own funds. It may consist of cash or financial instruments deposited with a single financial institution. The investor may invest in his own name or through the intermediary of an investment entity.

LUXEMBOURG : APPLICATION PACKAGE

  1. Application forms:
    a. the investment project as foreseen by article 53bis, par. (1), points 1 and 2 to the minister in charge of the economy; b.The proof of the investment, or the project of investment, as foreseen by article 53bis, par. (1) points 3 and 4 to the minister in charge of the finances.
  2. A recent ID color photo, 35×45 mm;
  3. Certified copy of his/her valid passport, in its entirety and ID card;
  4. Birth certificate, marriage certificate (if applicable);
  5. Recent extract from his/her police record or an affidavit issued in the country of residence;
  6. Diploma;
  7. Health insurance covering risks on the territory of Luxembourg;
  8. Motivational letter;
  9. Vaccination book for children under 16 years old;
  10. School certificate for children under 16 years old;
  11. Registration of your children in a school;
  12. If the application is submitted by a third person, proxy form.

LUXEMBOURG: IMMIGRATION PROCESS

  1. Consultation regarding immigration for investors to Luxembourg;
  2. You will prepare, legalize and post all necessary documents to us for verification
    Our certified translators will translate all documents into French or German if necessary;
    Note: Prior to submitting the application to obtain a residence permit as an investor, the applicant must submit proof of his investment or his plan in order to obtain the opinion of the Minister responsible for finance as following:
  3. The investment project as foreseen by article 53bis, par. (1), points 1 and 2 to the minister in charge of the economy;
  4. The proof of the investment, or the project of investment, as foreseen by article 53bis, par. (1) points 3 and 4 to the minister in charge of the finances. 
    The Ministry of Finance shall then notify the applicant of his opinion. If approved and successful:
  5. We will prepare your immigration file and apply to the Ministry in charge of immigration and after approval to consulate of Luxembourg;
  6. The visa (if/when approved) will be delivered by a consular service few weeks later;
  7. You will come to Luxembourg and within three working days must submit a declaration of arrival to the municipality of the chosen place of residence; You have 3 months to:
  8. Pass a medical test with a general doctor. The results will then be sent to the Medical Department who should inform the Immigration Department if the medical conditions are fulfilled in order to obtain a Luxembourgian residence permit;
  9. Apply to the Immigration Department for the issue of residence card;
  10. Go to the Immigration Department for the bio-metric data (photo and fingerprints);
  11. Come in person to get residence card at the Immigration Department;
  12. Return to the municipality to confirm the immigration status and receive a certificate of residence (certificate de résidence).

LUXEMBOURG : ADDITIONAL INFORMATION

If all the criteria described above are met, the applicant is issued with an “investor” residence permit valid for three years. This residence permit may be renewed for the same duration when necessary.  After a maximum of 12 months of the residence permit being issued, the Minister that initially gave an opinion on the application will re-verify the criteria required by Article 53a and if conditions are no longer met, one additional year may be granted to correct the situation. Beyond this deadline, if the criteria are still not met, it may be recommended to the Minister responsible for immigration to “withdraw residence permit in accordance with Article 101”. To avoid the withdrawal of his residence permit, the holder of the permit must be able to produce all relevant documents asked by Ministry of finances.

LUXEMBOURG: FAMILY

If at the moment of the application, you included your spouse and children in the documents they will obtain the same immigration status and Residence Card as you.

LUXEMBOURG: CITIZENSHIP

After successfully getting the residence permit as investor and immigrating to Luxembourg you and your family may apply for citizenship after seven (7) years living in Luxembourg.

ARGENTINA: IMMIGRATION FOR INVESTORS

ARGENTINA: LAWS AND REGULATIONS

Immigration laws (Ley de migraciones No 25871, decreto 616/2010).

ARGENTINA: CONDITION

Invest 1.500.000 pesos argentins (about €140 000) in a productive or commercial activity or in a service in Angentina.

ARGENTINA: REQUIRED DOCUMENTS  

  1. Passport;
  2. Three (3) ID pictures;
  3. Two (2) police certificate (+16 ans), from less then three (3) months;
  4. Two (2) birth certificates no older then three (3) months;
  5. Two (2) marriage/ divorce/ death certificate of the spouse, no older then three (3) months;
  6. Justification of housing;
  7. Permiso de Ingreso”;
  8. Proof that you have enough financial resources to support yourself while you are in Argentina;
  9. Proof of professional experience in the chosen field of investment;
  10. Letter of motivation explaining the reasons you desire to live in Argentina;
  11. Investment project, specifying the amount to be invested, the field of activity and the date at which the said activity is to start;
  12. Bank attestation confirming the existence of 500.000 pesos (or  €140.000).

ARGENTINA: IMMIGRATION PROCESS

  1. We offer you a private consultation to explore the best option for you to get the residency permit in Argentina;
  2. Prepare, legalize and apostatize all required documents;
  3. You team of sworn translators will translate all you documents in Spanish;
  4. Once all the documents are gathered into a file, they have to be submitted to the Direccion Nacional de Migraciones in Argentina;
  5. When all documents have been approved by the Direccion Nacional de Migraciones, they have to be submitted to the Consular Section in order to obtain an entry permit;
  6. As soon as the Consular Section has received the authorization from Dirección Nacional de Migraciones, it will enter in contact with you to schedule an appointment during which the procedure will be finalized;
  7. You will then obtain an immigration visa allowing you to enter to Argentina.

ARGENTINA: FAMILY MEMBERS

If you desire to migrate with your family, you need to apply for the family reunification visa for each member of your family.

ARGENTINA: ADDITIONAL INFORMATION

COSTA RICA: CONDITION

Provide a document demonstrating that you will be investing at least US$200,000 in Costa Rica

COSTA RICA: REQUIRED DOCUMENTS

  1. Completed form, given to you by the Costa Rican Migration Authority;
  2. Letter of application for permanent residency, describing the reasons for the application, and must include the following: i) First and last name, ii) nationality and age, iii) profession or occupation, iv) address, v) location or mean by which to receive the notifications et vi) date and signature;
  3. Payment of fee
  4. Two (2) colored photos
  5. Digital prints info, given to the Security of Costa Rica
  6. Certificate of birth, and marriage (if concerned) 
  7. Police certificate 
  8. Passport (copy of all pages)
  9. Proof that you are or will invest at least US$200 000 in Costa Rica

COSTA RICA: IMMIGRATION PROCESS

  1. We offer you a consultation regarding the process and the different steps to undertake in order to be granted a residency permit in Costa Rica;

  5. Meet the required qualifications according to the point system

REQUIRED DOCUMENTS:

  5. Marriage certificate
  6. Diplomas and certificates
  7. Documents confirming and describing your professional and/or business activity (employment history, employment contract)
  8. Evidence you have at least two (2) out of five (5) years of experience in management
  9. Bank certificates confirming the legal source and existence of financial funds (minimum $1,600,000 CAN)

IMMIGRATION PROCESS:

  1. We will provide you a consultation regarding: the process of immigration to Canada, the procedures of obtaining a residence permit, questions related to education, insurance, integration, healthcare, administrative and other aspects associated with your move to Canada
  2. Signature of the agreement
  3. You will have to prepare and legalize the required documents
  4. We have a team of sworn translators who are responsible for translating all the documents into French or English
  5. We will submit your application to the Quebec Immigration authorities and to the Direction du courrier, de l’encaissement et de l’évaluation comparative (in Montréal)
  6. After obtaining a CSQ (certificat de sélection du Québec), we will apply to the Canadian Immigration authorities
  7. Canadian Consulate will verify your medical exam and police certificate
  8. In case of a favorable answer, before obtaining a Canadian visa, you must transfer $ 800,000 CAN to a Canadian broker or trust company (who is authorized by government),
  9. Canadian Immigration Visa will give you the right to come to Canada and will issue you a permanent resident card, valid for five (5) years
  10. After five (5) years, the broker or trust company will reimburse you $800,000 CAN

ADDITIONAL INFORMATION:

  1. Please note that Quebec has a quota with regards to the number of applications accepted within one (1) year. Therefore, Quebec is willing to accept only 1750 applications starting on August 31st 2015 and ending on January 31st 2016
  2. Investor applicants from France, Belgium, Luxembourg and Switzerland are not considered in the quote
  3. In order to keep your Canadian resident card, you must stay physically on Canadian soil for at least two (2) years in a five (5) year period

FAMILY MEMBERS:

The members of your family will be included in the immigration process to Canada. Therefore, they will obtain a Canadian permanent resident card.

CANADIAN CITIZENSHIP:

After living in Canada for at least four (4) years in a period of six (6), your family and you are qualified to apply for Canadian citizenship.

  13. Certificate confirming the number of shares in an Irish Real Estate Investment Trust, OR

IMMIGRATION PROCESS:

IMMIGRATION PROCESS
