BRAZIL: PROCESS

Under the new law of 23 October 2008 on Luxembourg nationality, there two following ways of possessing or acquiring citizenship of the Grand Duchy of Luxembourg:

CONDITIONS (NATURALISATION)

LUXEMBOURG: PROCESS

  1. We will provide you with a consultation regarding the immigration process and the steps to undertake in order to obtain citizenship of Luxembourg;
  2. You have to prepare and legalize all the required documents;
  3. We have a team of sworn translators who will be translating all the documentation into French or German;
  4. We prepare your application and submit it by the municipalities to the Ministry of Justice;
  5. The decision might be made within 8 months from the declaration of naturalisation;
  6. Entering into effect of the naturalisation from the day of the decision; 
  7. In a case of a favorable decision, you will obtain a certificate of nationality, which must be included in your application for obtaining a passport of Luxembourg.

CONDITIONS

  1. Have resided in Brazil for at least four (4) years;

Citizenship Law (Staatsbürgerschaftsgesetz)

CONDITIONS:

  1. To live in Austria for at least 10 years and be a permanent resident no less than 5 years
  2. Have sufficient and permanent financial means
  3. Knowledge of the German language and the history of Austria
  4. To be successfully integrated into the Austrian society

REQUIRED DOCUMENTS:

SPAIN: CITIZENSHIP TO SEPHARDIC JEWS

Starting October 1st 2015, Spain will grant the right of citizenship to Sephardic Jews whose descendants were expelled from Spain in 1492.

CONDITIONS

  1. Present evidence of Sephardic Jew status;
  2. Demonstrate special connection to Spain;
  3. Have basic knowledge of the Spanish language and culture.

REQUIRED DOCUMENTS

  1. Completed application form;
  2. Birth certificate;
  3. Police certificate (for the last five (5) years prior the application);
  4. Certificate of the Federation of Jewish Communities of Spain;
  5. Certificate by the President of the Jewish community of your residence or birth place;
  6. Certificate from the rabbinical authority;
  7. Documents confirming Spanish origins (Sephardic Jew);
  8. Proof of knowledge and use of the ladino or “haketia” language;
  9. Two test results (basic knowledge of Spanish language and of the Spanish Constitution and culture).

IMMIGRATION PROCESS

  9. The notary will request additional documents, reports and may make supplementary verification of the Ministerio del Interior y Ministerio de la Presidencia;
  10. If your application is complete, you will be asked for an appointment with a Spanish notary in order to confirm your information and do a background check;
  11. After a favorable decision, you will be invited to take an oath of allegiance to the King and obedience to the Spanish Constitution and laws;
  12. You will obtain a Spanish citizenship;
  13. The process can last up to one (1) year.

  1. When you obtain your Spanish citizenship, you do not need to renounce on your previous and other citizenship;
  2. Starting October 1st 2015, applicants will have only three (3) years to apply for Spanish citizenship;

PORTUGUESE NATIONALITY

By virtue of law – to persons born abroad whose birth certificate bears the wording of the mother or father was in the service of the Portuguese State, the date of birth, the declarant shall submit proof thereof.

The Portuguese government may grant naturalization if:

  1. To persons born abroad with at least one parent in the direct line of Portuguese nationality and has not lost this nationality.
  2. There is evidence of ancestry of Portuguese nationality, to members of communities of Portuguese origin, and foreigners who have provided relevant services to the Portuguese State or the national community.
  3. By option – Children of a Portuguese mother or father is eligible for Portuguese nationality.
  4. Through marriage, if married abroad for more than three (3) years with a Portuguese citizen.

POLAND: CITIZENSHIP

A foreigner may solicit citizenship by virtue of law from Poland if:

  1. At least one of the applicant’s parents is a Polish Citizen,
  2. The applicant was born in the territory of the republic of Poland, and the identity of the parents is unknown, and no citizenship can be ascertained.
  3. A minor will automatically be granted Polish citizenship if found on Polish territory.

Note that an adopted minor under the age of 16 will be assumed to have had Polish citizenship since birth. Recognition:

  1. One must comply with the following before Poland will acknowledge a foreigner as a Polish citizen:
  2. Each year, the government of Canada announces how many immigrants it aims to attract over the coming year, and reveals a breakdown in the number of immigrants that will be allocated to the various immigration programs offered.
  3. Must have documentation of the occupied dwelling as well as a regular source of income in Poland.
  4. Must have lived at least two (2) years in Poland and be married to a Polish citizen or hold no citizenship of their own.
  5. Must have lived continuously for at least 10 years in Poland with a permit to settle, regular income in Poland, as well as a legal title to a dwelling.
  6. Live in Poland for two (2) years and have Polish ancestry.

Applicants should have satisfactory command of the polish language.

  3. Any child born to a Monegasque father is Monegasque automatically.
  4.  A person is considered to hold full Monegasque nationality from the date of their birth if:

Terms and Conditions for Hungarian naturalization:

1. The applicant must have lived continuously in Hungary for a specified period of time and must have had permanent residence (residence card).
2. The applicant has good standing with local law enforcement.
3. The applicant can provide and shelter him/herself in Hungary.
4. The applicant must have a satisfactory command of the Hungarian language.

Preferential naturalization

I. Requirements for preferential naturalization in Hungary (after living in Hungary for three (3) consecutive years):
1. Married with a Hungarian citizen for at least three years.
2. Is the legal guardian of a minor child who is a Hungarian citizen.
3. Was adopted by a Hungarian citizen.

Non-Hungarian citizen are eligible for preferential naturalization when:

  1. Any ancestors where Hungarian,

  3. Has good standing with local law enforcement

Applicants who meet the following requirements are eligible for preferential naturalization only after residing in Hungary for five (5) consecutive years:

BRITISH OVERSEAS CITIZEN

What is a BOC? Although almost the same as a standard UK citizen, this type comes with minor differences; one can apply for the British passport and receive assistance and protection from any UK diplomatic posts but does not have the right to work or live in the UK. A citizen with BOC is not considered a UK national by the European Union.

ACT AND REGULATIONS

  • The British Nationality Act 1981
  • The British Overseas Territories Act 2002

Stateless people are able to register if that person:

  1. Was born outside the UK and qualifying overseas territories,
  2. At least one (1) of your parents is a BOC (British overseas citizen),
  3. Have lived in the UK or overseas territory for at least three (3) years.

Automatic citizenship on January 1st 1983 for the following cases:

  1. The applicant was a citizen of the UK and its colonies on December 31st, 1982,
  2. You have not become a British citizen nor BOC.

Citizens by virtue of solitary ties to Hong Kong lost their citizenship on July 1st, 1997 unless:

  1. The individual has no other nationality or would have become stateless,
  2. If you were born after July 1st, 1997 and would have been stateless
  3. If one (1) of your parents was a BOC or simple British national when you were born.

UK: CITIZENSHIP

ACT AND REGULATION

  • The British Nationality Act 1981

Although there are several ways in which to acquire citizenship from the UK, naturalization is the most common way to acquire British citizenship and you qualify if you met the following conditions:

  1. Of legal age (18+),
  2. Of good character,
  3. Desire to continue to reside in the UK,
  4. Have met the cultural and linguistic requirements.

In most cases, the following requirements are also taken into consideration:

  1. Having lived in the UK for at least five (5) years prior to the solicitation,
  2. Have not spent more than 450 days outside of the UK during those five (5) years,
  3. Have not spent more than 90 days outside of the UK in the past year.
