IMMIGRATION TO SAN MARINO

When an individual wishes to stay within the territory of San Marino for more than 10 days, said individual must obtain a permit. Although there are several different types of permits, we usually recommend the following type:
The ordinary permit, which is issued by the State Congress, allows you to stay within San Marino for a maximum of 90 days and can be renewed every 90 days. It is important to note that this permit may allow you to work in San Marino.

How to obtain a residence permit in San Marino

In order to obtain a residence permit, an individual must have gone through this process of renewal for at least five years; following this the individual may apply for the residence permit. Please take not that this five year period must be uninterrupted.
Only the following authorities have the authorization to issue residence permits: the Permanent Commission for Foreign Affairs, Emigration and Immigration, Information, Transport and Tele-communication, Police and Public Order.

CITIZENSHIP OF SAN MARINO

Citizenship in San Marino is obtained by birth when the father and mother are both San Marino citizens. When only a single parent is a citizen of San Marino, within 12 months after child reaches the age of 18, both parents must declare that they wish to choose the citizenship of the parent that is a citizen of San Marino.

Citizenship in San Marino is also obtained by birth in the Republic, in case both parents are unknown or stateless.

The children of all San Marino citizens of 18 years of age, who continue to reside in in the territory of San Marino for a minimum of 10 years, can obtain citizenship.

One of the requirements to obtain this citizenship is good conduct; the applicant must not have been convicted of a criminal offence domestically or abroad, moreover, the applicant must not have been charged with a prison penalty or interdiction for over 1 year.

In cases of naturalization, citizenship is awarded to a foreign person by the Grand and General Council with legal provisions to be passed with a qualified two-thirds majority.

At the approval time of the legal provision, it is necessary that the applicant appear in the Registry Office for resident inhabitants and must not have been convicted of a criminal offence (unpremeditated) in the Republic or abroad, the applicant must not have been charged with a prison penalty or interdiction for over 1 year.

To obtain citizenship it is necessary to renounce any other citizenship and to have effectively continued to reside in the Republic for at least 30 years.

Foreigners residing in the Republic from birth can request naturalization when one of the parents or relatives up to the 2nd degree has maintained continuous residence in the Republic for 30 years. Citizenship obtained by naturalization may also be passed on to children of minor age.

In case of residence abroad, the applicant must appear before the appropriate authorities accompanied with all relevant documents and the authorities will then forward the documentation to the Registrar.

The following is a list of documentation that is required in order to apply successfully for a Passport of San-Marino.

  1. Certificate of nationality (or of statelessness)
  2. Birth Certificate
  3. Certificate of residence
  4. Certificate of enjoyment of civil capacity
  5. Police Certificate of good conduct
  6. Certificate of pending charges (or equivalent document)
  7. 2 passport photos, including 1 certified

ENTREPRISE À SAN MARINO

Le montant du capital ne devrait pas être inférieur à 25,500.00 EUR pour les sociétés à responsabilité limitée et 77,000.00 euros pour les entreprises. Lois San Marino indiquent qu’au moins la moitié de l’apport en capital initial doit être faite dans les soixante jours de congé après la date d’inscription et si vous payez en espèces, pour être déposés dans un établissement de crédit à Saint-Marin. Si la société est unilatérale, toutes les contributions doivent être versées en espèces et dans les soixante jours après la date d’inscription. Dans tous les cas, le paiement de toutes les contributions doit être demandée par les administrateurs dans les trois ans à compter de la date d’enregistrement de la société.

IMPOTS DIRECTS

IGR est l’impôt général sur le revenu qui, pour les salariés est appelé IGRL (impôt des personnes physiques et système de retenue à la source) et pour les entreprises, IGRP (taxe pour les personnes morales). Impôts généraux à Saint-Marin est de 17% du résultat net et appliquées sur les bénéfices des personnes morales. Seuls les revenus réalisés à Saint-Marin est imposable et ceux qui sont ou ne sont pas résidents sont imposés sur la base de tranches d’imposition et les calculs d’impôt progressif.

Cette taxe est de négocier et est une forme de fiscalité indirecte, est applicable uniquement lorsque les marchandises sont importées à Saint-Marin. Le taux normal dans ce type d’importation est de 17% de l’assiette fiscale comme cela est considéré comme une importation, est reconnu comme équivalent à la TVA (taxe sur la valeur ajoutée).
