01 | Residency for Investors

To qualify under the investors program in Luxembourg, one will have to select one of the following three investment options:

  • A 5-year investment of at least 500,000 euros in a new or already established business in Luxembourg.
  • An investment of at least 3,000,000 euros in a Luxemburger bank. This investment is expected to be maintained for as long as you remain a resident investor in Luxembourg and to be managed via a portfolio that can include stocks or funds, depending on the bank’s offers and the associated risks. The goal of this investment is to produce and guarantee a stable income from the investment.
  • A 5-year investment of at least 20,000,000 euros in a local bank.

Before proceeding with submission of an immigration file, all of your documents will have to be properly legalized and translated into either German, French, or English. The provided list is an example and the detailed list of documents needed might differ based on the applicant’s unique case and circumstances.

The application process for a residence permit under the investor program in Luxembourg is based on 3 main steps.

1. First step: Application for an authorisation to stay

The first step of the process consists of applying for a permission to stay in Luxembourg. An application will have to be sent to the Luxembourg immigration authorities. Based on the selected investment option, the organization that will receive the application will differ. If the investment concerns a local business, in this case the application will have to be forwarded to the Ministry of Economy. In case of an investment in a local bank, the application will have to be addressed to the Ministry of Finance.
In the event that the application file is approved, a temporary permit valid for 3 months will be issued.

2. Second step: Visa application

A visa application will be required in the event the applicant requires a Schengen visa to enter Luxembourg.The visa application will be handled by the Consular services of Belgium.

3. Third step: Travel to Luxembourg and validate the stay

After receiving the authorization of stay and a visa if required, the applicant will be able to travel to Luxembourg. Upon the applicant’s arrival, it is important to declare the official arrival to Luxembourg. A medical examination is expected to be conducted.
This step, along with the authorization, gives the right to reside in Luxembourg until the official residence permit is issued.
With these preparations accomplished, the applicant can proceed to apply for residence permit in Luxembourg as an investor.
It’s worth mentioning that during different stages of the process, the selected investment will have to be executed.
During the first year’s validity of the residence permit, the Ministry of Finance will reach to the applicant with the objective of confirming the compliance with the investment commitments made.

An investment in a business will have to be included in one of the categories approved by Luxembourg regulation. Activities in the craft, industrial and commercial fields are allowed.

Furthermore, several fields or professions need to comply with Luxembourg regulations. Specific authorizations or accreditations may be necessary to obtain the right to practice the profession in the country.

Different trades demand a business or operating license. This requirement is relevant to the catering sector, employment agencies, specific industrial operations, security, and surveillance firms, among others.

02 | Citizenship of Luxembourg

Luxembourgish citizenship can be acquired through the process of naturalization. Naturalization confers upon the person concerned all the civil and political rights associated with being a Luxembourgish national. The main requirements are the following:

  • To have legally resided in Luxembourg for at least 5 years. The final year of residence immediately preceding the naturalization application must have been uninterrupted.
  • Justify knowledge of the Luxembourgish language, as evidenced by a Luxembourgish language test pass certificate and have taken the ‘Vivre ensemble au Grand-Duché de Luxembourg’ course or passed the test covering the topics taught in this course.
  • Acquiring Luxembourgish nationality is subject to a condition of good repute. Consequently, Luxembourgish nationality is refused:
  • If the applicant has made false statements, concealed important information or acted fraudulently during the naturalization procedure.
  • If the applicant has received, in the Grand Duchy of Luxembourg or abroad:
  • A criminal sentence or a custodial sentence of 12 months or more; or
  • A suspended sentence of 24 months or more.

The following list of documents is required to apply for citizenship of Luxembourg via naturalization. Additional documents may be required based on the applicant’s specific situation and rules in place.

  • Birth certificate.
  • Passport.
  • Police certificate from the country of citizenship and of any country of residence since the age of 18 years old and during the previous 15 years preceding the submission of the citizenship application.
  • Luxembourgish language test pass certificate.
  • Certificate confirming the attendance of the ‘Vivre ensemble au Grand-Duché de Luxembourg‘ course or passing of the exam covering the course.
  • If applicable, a decision of the Minister authorizing an exemption from submitting one or more of the required documents. This exemption can be obtained upon reasoned request from the Minister of Justice, who has sole authority to grant it.
